GENERAL CONDITIONS OF CAR RENTAL

at AUTOSERVISHAUS.CZ s.r.o., which are an integral part of the Vehicle Rental Agreement.

1. Rental Terms

The vehicle may only be rented to a person over 18 years of age who is also a holder of a Group B driving licence for at least 2 years, and who presents the appropriate documents in accordance with point 4 of these General Conditions of Car Rental before renting.

2. Vehicle reservation

Reservations are made by phone or in person. In case of booking by e-mail, the reservation must be made 48 hours in advance and the renter must wait for the landlord’s confirmation.

3. Rental period, extension of rental period, rates for non-compliance

The rate per day is calculated for 24 hours from the start of the rental, i.e. from the moment of signing the vehicle rental agreement. The minimum rental period is one day, i.e. 24 hours. If the daily rental time is exceeded by more than 1 hour, the entire next day will be charged. The rental period can be extended if the renter requests it in writing, by phone or in person at least 8 hours before the rental period expires. A telephone or personal request for an extension must be followed up in writing. Such lease extension must be approved by the landlord. If the lease agreement is not renewed in the above manner, the lessee shall be obliged to pay the rent at the basic rate and all other costs associated with the non-compliance with other contractual arrangements incurred by the lessor to the next lessee. In the event of an accident or technical breakdown, no rental fee is charged for the rental vehicle during the repair period.

4. Documents required for the conclusion of the contract

The following documents must be presented when concluding the vehicle rental agreement.

Company:

• Extract from the Commercial Register
• Order on letterhead with signature of the statutory representative
• Power of attorney from the statutory representative (if not present at the acceptance)
• Identity card or driver’s passport, driver’s licence, sk. B driver.

Sole trader and private individual:

• ID card
• driving licence sk. B
• trade certificate (for a sole trader)

Strangers:

• passport
• driving licence
• credit card

The documents must be presented at the latest before the loan. If a booking confirmation has been sent to the hirer in advance, it must be presented at the time of concluding the vehicle rental contract.

5. Deposit and its settlement

This amount of money is used to secure the obligation arising from the rental of the vehicle by the customer. The Lessee shall pay this amount in cash or by bank transfer before the commencement of the lease. The amount of the deposit is stated in the Price List. The landlord may use the deposit or part of it for the costs incurred by the tenant in breach of the contract. This provision applies in the event of arrears on return, damage to the vehicle and its equipment, for damage caused to third parties or entities and in the event of non-compliance with other contractual provisions, namely for late return of the vehicle and the subsequent costs incurred by the lessor.

6. Rental includes

Rental price includes:

• service costs,
• Consumption of operating fluids excluding fuel,
• statutory third-party liability insurance,
• accident insurance,
• road tax and
• vignette for the Czech Republic.

7. Tenant’s obligations

When using the rented vehicle, the renter is obliged to comply with all applicable regulations, in particular the rules of the road, and to act in such a way as to avoid damage to property or health. The Lessee further undertakes to use the car exclusively on public roads designated for this purpose. They must not use the car for test or competition drives and must only ever fill up at public service stations of reputable and authorised fuel retailers. In the event that a traffic offence is committed, the lessee undertakes to pay the fines for offences proven to have been committed during the rental period within fourteen days of receipt of the notice by the lessor.

The rental car may only be used in accordance with the manufacturer’s instructions and the rental company’s instructions. In the event of a malfunction of the speedometer, you must immediately stop the car and inform the lessor (see paragraph 14. Assistance). No modifications or changes can be made to the vehicle. The lessee is obliged to attend the service inspection at the agreed interval. The lessee pays for the washer fluid and fuel in full.

8. Next driver

The standard car rental is always only to one responsible driver – the renter. The renter charges a one-off fee of CZK 200,- excluding VAT for an additional driver.

9. Tenant’s liability and compensation for damages

The lessee is obliged to pay all costs associated with the liquidation of damage to the vehicle or in connection with its operation during the rental period if he fails to comply with the agreed “General Terms and Conditions of Car Rental”.

In the event of a traffic accident caused by his/her fault, if the perpetrator of the accident is not identified, or in the event of any damage to the vehicle and its accessories, or in cases where it is not possible to claim compensation for damage from other insurance, the Lessee is obliged to pay a minimum deductible of 10%, but a minimum of CZK 10,000 (unless both parties agree otherwise) and to pay for towing to a repair shop designated by the Lessor, or to pay for the towing of the vehicle. by agreement of both parties to the landlord’s registered office. In the event of theft of the rented vehicle, the renter is obliged to pay the lessor a deductible of 10% of the purchase price of the vehicle. In the event of unauthorized use of another’s property, in the event of obtaining the vehicle from the lessor by fraudulent means, in the event of failure to present the keys in the event of theft of the vehicle or in the event of providing the vehicle to a third party without the prior written consent of the lessor, or in the event of obtaining the vehicle from the lessee by another person by fraudulent means, the lessee is obliged to pay the lessor the purchase price of the vehicle. In such cases, the landlord may also claim compensation from the tenant for lost profits in the form of rent, namely:

(a) in the event of the vehicle being out of service for the duration of the repair
(b) in all other cases, until the case is closed.

The Lessee is obliged to reimburse the Lessor for any legitimate claims or possible deductions of the insurance company with which the subject vehicle is insured according to the relevant insurance conditions. The Lessee must immediately report any damage incident, including damage to or destruction of the leased vehicle, theft of the vehicle or any part thereof, to the Lessor and the police, and must also provide an inventory of all parties, witnesses, vehicles and other items involved. In the event of failure to comply with this obligation, the insurance company will take action against the tenant. Tenant expressly agrees that rent, damages and any other legitimate claims against Tenant set forth in the Rental Agreement or these Terms and Conditions may be charged by Landlord to Tenant’s credit card or bank account. If the tenant does not have cash, the landlord may recover the amount owed by a lien and subsequent sale of all movable and immovable property of the tenant. The Lessee shall pay for all damages, including lost profits during the repair of the vehicle, caused by driving the rented vehicle under the influence of alcohol, drugs or medication. By signing the contract, the Lessee acknowledges that any additional charges will be made according to the Lessor’s valid price list. All apparent defects, complaints and comments regarding the rented vehicle must be submitted by the renter at the latest upon taking over the vehicle and must be recorded in the rental contract or handover protocol.

10. Car rental location

Delivery of the ordered car is only at the premises of AUTOSERVISHAUS.CZ s.r.o., unless otherwise agreed in advance, at Vančurova 1297, 36301 Ostrov.

11. Place of car return

The return of the car is always identical to the place of rental, unless otherwise agreed in writing and in advance. The Lessee acknowledges that in case of non-payment of rent, in case of non-return of the vehicle on the agreed date, or in case of breach of the contractual conditions, the Lessor is entitled to immediately remove the leased vehicle or to use a vehicle retrieval device and to arrange for the return of the vehicle to the Lessor by an agency authorized for such activities, with the costs being borne by the Lessee. The Lessee further acknowledges that in the event of non-return of the vehicle, the entire matter will be referred to the competent criminal authorities for consideration. The contractual penalty in such cases is CZK 1,500,- excluding VAT for each day of delay.

12. Fuel and fuel accounting

Rates according to the price list do not include fuel. The vehicle is handed over with a full tank of gas and returned to the renter with a full tank of gas. A one-off fee of CZK 500 excluding VAT is always charged for refuelling the missing fuel at the end of the loan.

13. Vehicle cleanliness

The rental vehicle must be returned completely clean, and it is considered clean if the exterior of the vehicle (windows, bodywork including the windows) and the interior (dashboard, seats, footwell, storage compartment) do not show signs of visible dirt or damage. This provision also includes a ban on smoking in the vehicle.

In case of non-compliance with this provision as a whole or only one part of it, the lessor has the right to charge a one-time fee of CZK 500 excluding VAT for the complete washing and cleaning of the car.

14. Assistance service

In case of any difficulties, the tenant should always first contact the landlord at tel. č. +420 775 100 882 or 777 674 039. If necessary, the lessor will arrange for a towing service to transport the car to the company’s headquarters. After consultation with the landlord, towing can be arranged by the tenant. In any case, the lessee must always inform the lessor and the lessor will decide how the vehicle will be towed or put into operation to the satisfaction of the lessee. The costs associated with towing and/or putting the vehicle into operation will be recharged to the renter depending on the origin and extent of the defect or damage.

15. Payment for rent

Payment for the rental of the car is always made in cash at the place of return or, if agreed in advance on the day of rental, by bank transfer, payable within 7 days of the return of the car.

16. Contractual penalties

The lessee is obliged to pay the lessor a contractual penalty of CZK 5,000 if the leased vehicle was driven by a driver other than an authorised driver or left the Czech Republic without the lessor’s prior consent.

17. Insurance

The rental price includes compulsory liability and accident insurance, glass insurance and personal accident insurance. However, the accident insurance is agreed with limited liability for damage caused by the car renter’s own fault, for damage caused by failure to comply with the terms of these General Conditions of Car Rental or failure to comply with the technical conditions of operation of the vehicle set by the manufacturer. Always with a minimum participation of 10%, but with a minimum of CZK 10,000. The renter is not responsible for items left in the vehicle.

18. Securing a parked vehicle

The Lessee is always and under all circumstances obliged to lock the vehicle properly when parking the car, and if the car is equipped with mechanical security devices such as. reverse lock, always use it. In case of theft of the vehicle and proving that the car was not properly secured, the renter pays all costs associated with the loss and a flat daily rate of CZK 1,000 excluding VAT until the Police and the Insurance Company resolve and close the case.

19. Other Arrangements

By signing this Motor Vehicle Rental Agreement, the Lessee undertakes to comply with the provisions of the General Rental Terms and Conditions and undertakes to pay all damages and claims of the Lessor arising from any failure to comply with them, regardless of whether the breach was intentional or negligent. Any additional individual agreements on the terms and conditions of the vehicle rental must always be confirmed in advance and in writing by the lessor. The lessee agrees to store his personal data in the database of car lessees at AUTOSERVISHAUS.CZ s.r.o. If the Lessee is in default with the payment of any obligation under the motor vehicle rental agreement and these General Terms and Conditions, he is obliged to pay the Lessor a contractual penalty of 0.2% of the amount due for each day of delay.

20. Privacy Policy

The Client confirms that he/she is aware of his/her rights regarding the protection of personal data arising from generally binding regulations, in particular from Act No. 101/2000 Coll., on the protection of personal data, as amended. The Client understands that the data about his/her person, which the Lessor has obtained from him/her in connection with the conclusion of the lease agreement, will be kept on record for the period required by generally binding legal regulations and necessary for the protection of the Lessor’s interest, and that the Lessor will use such data exclusively for the purposes of providing its needs, in particular for the purposes of administering the lease agreement, offering other services, or recovering debts from the Client, whereby the aforementioned services may be provided for the Lessor by third parties.
